Few things in life are more traumatic than being involved in an auto accident. Although the accident may happen in just a few seconds, the moments immediately after the accident can be critical to protecting yourself from a lawsuit that might occur as a result of the accident.

Here are some steps to take in the moments after the accident.

Documentation

After making sure that the appropriate authorities have been called (you should always call the police, no matter how small the accident), you must begin the process of documenting the accident.

  • Visuals: providing a visual representation of the scene and the vehicles can help your lawyer defend you're found at fault or partially at fault for the accident. Be sure to take photographs of your vehicle, the other vehicles involved in the accident, the roadway, and any other distinguishing features that might have played a factor in the accident.
  • Eyewitnesses: to corroborate your story, it's important to get eyewitness accounts (if possible). If there are pedestrians, other motorists, or business owners who might have seen the accident, ask them for permission to shoot a video of them recounting what they say. Be sure to get the eyewitnesses' names, phone number, and address (if they're willing to share that information).
  • Police: once the police investigate the accident, they will produce a written report. You should be sure to get a copy of this report. It's important to remember that the police will not decide your case, don't try to sway their opinion about what happened. Providing them with honest and accurate information is your best course of action.
  • Testimonial: when you have a chance, record your recollections of the event, using as many details as possible. Capturing this on video is more efficient, you can transcribe what you record later for your lawyer and/or police if needed.

Who to Call?

Once you've compiled the necessary documents, you should make two calls after the accident.

  • Insurance: calling your insurance company immediately after the accident will expedite how your case is processed. Do not, however, provide them with the documentation discussed above until after you've consulted with an attorney.
  • Lawyer: calling a lawyer in the immediate aftermath of an accident can help them file any paperwork needed with your insurance company and/or court. Additionally, they may require time to shift through the documentation you compiled. Giving them the time to work through this information will help them develop a stronger case for you.
